✧By commissioning me, you are agreeing to the following terms. Please read carefully before placing an order.✧GENERAL
Commissions are for Personal Use only, as I do NOT accept commercial use commissions at the moment. My artwork may be used for personal display such as profile pictures, banners, posting on Socials with CREDIT, or printing for yourself, but may not be used for profit without prior agreement. AI/NFT use is strictly prohibited. My work may not be used in AI datasets, engines, or minted as NFTs. I reserve the right to decline commissions outside my abilities or for subjects I will not draw. Communication is important. If I do not receive a response within 1 week, I will put the commission ON HOLD until I receive a reply; this also includes your thoights if the updated rendering and colors to avoid last-minute revisions. I also may decline any commission request that I am not comfortable with, or if it is beyond my capabilities.✧PAYMENTS & FEES
All payments are paid upfront in full OR in split payment before I start and after the final is ready through the agreed platform. Payments to proposals should be paid fully including tax within 1 week STRICTLY or will be declined. A Non-Disclosure Agreement (NDA) fee of $30 applies if you request that I do not post your commission publicly or use it as part of my Portfolio. Complexity Fee is within the maximum between +35-50% for all Commissions. If you do not avail the complexity fee for chibis, details will be simplified.✧REVISIONS
You receive 3 free revisions after the sketch is approved. Additional revisions cost $10 each, paid before I continue.Once the Final is approved, no further changes will be made unless due to an error on my part. Mistakes I make will always be corrected at no cost, including ; details that I forgot to draw, wrong colors(not shade), etc.✧DEADLINES AND DELIVERY
Commissions may take up to 1 month depending on complexity, queue, health, or personal matters. I will keep you updated if delays occur, you may freely ask me for progress. If you wish to skip the Queue and be Priority, the fee will be $15 USD. Older clients and those who paid fully upfront will automatically be further prioritized than more-recent clients and split payment types. BUT, to receive a full artwork below the minimum of 1.5 weeks, you may avail the Rush fee for $20.✧INTELLECTUAL PROPERTY RIGHTS
I, the artist, retain all rights to the commissioned artwork. You are purchasing usage rights, not ownership of the artwork itself nor the right to label it as a creation by oneself.I may use the artwork to:
Promote myself and my services.
Post on social media and in my portfolio.
Create prints/merchandise (for fanart commissions only).
Exceptions:
If an NDA was purchased, the artwork will not be posted or used for promotional purposes.✧COMMISSIONER RIGHTS
You may:
Use the artwork for personal purposes only
Print the art for yourself
Post it on Social Media with credit to "@Xiaozh._ on tiktok ".You may NOT:
Use the artwork commercially (sell).
Commission art/services using my Design/Work.
Claim the artwork as your own or fail to credit me.
Remove signatures/watermarks.
Resell or redistribute the artwork.
Modify the artwork without my consent.
Use artwork purchased for Personal Use in merch, streaming, or commercial projects.✧BLACKLIST POLICY
Breaking these rules may result in a permanent public blacklist (with evidence) and one will be blocked or reported. The blacklist may be shared with other artists.✧REFUNDS
I may cancel and refund a commission at any time.You may cancel before payment is made. Refunds are not available unless I am unable to complete the Commission. Chargebacks are strictly prohibited.
Filing a chargeback will:
Forfeit your rights to use the artwork.
Place you on a public blacklist (with evidence).
Allow me to resell or reuse the artwork as I see fit.
Result in a formal complaint against you.✧FINAL AGREEMENT
By commissioning me, you acknowledge that you have read, understood, and agreed to all of the terms above.
